German Regulation Threatens Online Poker

Tuesday, 13 November 2012

Germany’s online sports betting bill, which would effectively make online poker in Germany illegal, took one step closer to completion yesterday according to PokerFuse.com as the two remaining states left to sign, North Rhine Westphalia and Schleswig-Holstein, indicated they back the treaty.

The State Treaty on Online Gambling is one which allows online sports betting but levies a 5% tax on every wager placed. This fact alone has prompted operators such as Betfair to leave the German market and others are expected to follow. Interestingly though, Betfair will continue to offer online poker to German residents, as will bwin.party, because there is doubt over the legality of the Treaty.

According to representatives of the European Gaming and Betting Association, the Treaty contravenes EU law and therefore, can’t be legally enforced. As such they have submitted a complaint to European Union, along with official support from many of the major gaming operators.
